This Privacy Policy (the “Privacy Policy”) applies to and describes how we collect, use, process, retain, and share your information, as well as your associated rights through our website www.remmiehealth.com (the “Site”), Remmie mobile applications (the “App”), digital examination tools such as Intelligent Home Otoscope and Specula (the “Device”), Remmie cloud services and platform (the “Platform”), and all content and documentation therein (collectively, the “Services”). It does not apply to information collected offline or by any third party, including through any other websites, applications, services, or content (including advertising) that may link to or from this Services.
Capitalized terms used but not defined in this Privacy Policy have the meaning given them in the Terms of Service.

To the extent that you use the Services on behalf of another user, such use must be conducted solely in strict compliance with the Terms of Service and this Privacy Policy, and you shall be solely responsible to have or receive and hereby represent that you have or received the consent, authority, permission and approval of such user to provide personal information and allow Remmie to collect, use, process, retain, and share such personal information in accordance with this Privacy Policy. If you are acting on behalf of another user who is a minor, you must also follow the terms in Section 9 herein.
2. What Personal Information Do We Collect?
For the purpose of this Privacy Policy, “personal information” means all information that identifies, relates to, describes, can be associated with, or could reasonably identify you as an individual, either alone or in combination with other non-personal information. It includes data like your name, phone number, email, address, demographics, account log-in credentials, as well as less obvious data like device and usage data. “Medical Information” includes physiological data of ear, nose, and throat (“ENT”) or other body parts, physiological data, diagnosis, tests, results, treatments, prescription, therapy, counseling, laboratory and any other health related information. “Non-personal Information” is non-identifying and non-identifiable information, without particular reference to your identity.
Your personal information can be provided directly by you, collected automatically by us, or provided by other sources.

d. Aggregated Data
We may collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data is de-identified or anonymized and does not constitute personal information as this data does not directly or indirectly reveal your identity. If we ever combine Aggregated Data with your personal information so that it can directly or indirectly identify you, we will treat the combined data as personal information which will only be used in accordance with this Privacy Policy.
e. Audiovisual Date
If the Services include a virtual visit that connects Patients with Clinicians via live video in real time, you acknowledge and agree that Remmie may record and store audiovisual data and related information associated with your personal information, whether provided by you or on your behalf. We will maintain and use this information in accordance with this Privacy Policy.
3. Why Do We Collect Your Personal Information?
a. Legal Basis of Use
We collect, process and use your personal information for the purposes described in this Privacy Policy, based at least on one of the following legal basis:
In Performing an agreement with you: We collect and process your personal information in order to (i) provide you with the Services, following your acceptance of this Privacy Policy and pursuant to the Terms of Service; (ii) maintain and improve our Services; (iii) develop new services and features; and (iv) personalize the Services in order for you to get a better user experience.
With your consent: We collect and process your personal information for specific purposes only with your consent, which you may withdraw at any time.
Legitimate interest: We process your information for our legitimate interests while applying appropriate safeguards that protect your privacy. This means that we process your information for things like (i) detecting, preventing, or otherwise addressing fraud, abuse, security, usability, functionality or technical issues with our services; (ii) protecting against harm to the rights, property or safety of our properties, or our users, or the public as required or permitted by law; (iii) enforcing legal claims, including investigation of potential violations of this Privacy Policy; and (iv) complying and/or fulfilling our obligation under applicable laws, regulation, guidelines, industry standards and contractual requirements, legal process, subpoena or governmental request, as well as our Terms of Service.
b. Purpose of Use
We may use the personal information for the following purposes:
To provide and operate the Services. This includes enabling at-home examinations, the transmission and communication of Medical Information between Patients and Clinicians, AI-powered tools to analyze medical images for the identification of potential abnormalities, and delivering other functions described at the time of collection.
To Communicate with You. We send updates, notices, notifications, and other communications regarding the Services.
To Manage Your Account and Provide Customer Support. We use your personal information to manage your account and deliver customer support. This includes reviewing your examination data and audiovisual recordings to detect and correct improper use of the Services, as well as diagnosing and resolving issues to enhance your experience.
For Research and Development. We analyze aggregated data to identify patterns, study treatment methods, and conduct medical or clinical research and development.
To Enhance Your Experience. We use anonymized data and common user preferences to evaluate and develop new features, technologies and to further customize and improve our Services, providing you with more relevant information and features.
To Protect Against Fraud and Security Threats. We use your information to prevent, detect, mitigate, and investigate fraud, security breaches, and other potentially prohibited or illegal activities.
To Market and Promote Our Services. We may send promotional communications that may be of interest to you, including by email and by displaying ads. We may also communicate with you about new services, special offers, promotions, and contests.
To conduct business planning, reporting, and forecasting. We process your personal information for analytics and measurement to understand how the Services are used.
For Legal Compliance. We use your data to comply with applicable laws and regulations, protect our legal interests, and respond to or defend against legal proceedings.
4. How Do We Share Your Personal Information?
We are committed to maintaining your trust. We want you to understand when and with whom we may share your personal information for business purposes.
a. For Legal Reasons
Where required by law or where we believe it is necessary to protect our legal rights, interests, and the interests of others, we use information about you in connection with legal claims, compliance, and regulatory. We may also disclose your information, including information about your interaction with the Services, (a) to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims, or government inquiries, (b) to protect and defend the rights, interests, safety, and security of the Services, its users, or the public, and (c) to enforce any terms applicable to the Services.
b. With Our Affiliates
We may share the personal information we collect with our subsidiaries and affiliates, if any, for the purposes described in this Privacy Policy.
c. In a Business Transfer or Transaction
We reserve the right to transfer personal information we have about you in the event of a corporate business transaction, like a merger or acquisition, divestiture, sale of company assets, or in the event of insolvency, bankruptcy, or receivership. In these cases, personal information could be transferred to third parties as a business asset. Should such a transfer or transaction occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with this Privacy Policy.
d. To Our Service Providers
We partner with certain third parties to provide selected services that are used to facilitate and enhance the Services (“Service Providers"). These Services Providers include hosting, database and server co-location services (e.g. Amazon Web Services), data analytics services (e.g. Google Analytics), payment processors (e.g. Shopify), session replay records for app analytic purposes such as crashes, functionality and usability, remote access services, data and cyber security services, fraud detection and prevention services, e-mail and text message distribution and monitoring services, customer support and call center services, and our business, legal and financial advisors.
These Service Providers may have limited and controlled access to personal information in connection with the services they provide. The Service Providers are bound by this Privacy Policy and other contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. The use of personal information by Service Providers outside of the agreed-upon service they provide is prohibited.
e. Clinicians and Third-Party Professionals
We may share with or allow Clinicians access to your personal information. Additionally, if the Clinicians, if so permitted under applicable law, determines that they require clinical/medical consultation with a third party clinicians, we may share your personal information with such third party professional, in order to provide you with the Services.
f. De-identified and/or Aggregated Data
We may create aggregated, anonymous, or de-identified data from personal information by removing or otherwise altering data components that make the data personally identifiable, or potentially personally identifiable to you (“De-Identified and/or Aggregated Data”). De-identified and/or Aggregated Data, which does not identify you personally, may include information about certain demographic groups, information about the device you use to access our Services, information about conversational trends, or other analyses we create.
While De-Identified and/or Aggregated Data is not considered personal information and doesn’t require coverage in this Privacy Policy, we are committed to transparency and disclose the following: To deepen our understanding of users and our Services, we may analyze De-Identified and/or Aggregated Data to operate, maintain, manage, and enhance the Services. Additionally, we may share De-Identified and/or Aggregated Data with our affiliates, agents, business partners, and other third parties for lawful purposes.
g. With Your Consent or at Your Direction
We may disclose your personal information to third parties with your consent, which we may get in writing, online, or orally. We may also share your personal information with third parties when you tell us to or when you use our products or services to interact with third parties, whose separate privacy policy may apply to that data.
5. How Do We Transfer Your Personal Information?
The Services are intended for users located within the United States. If you are located outside United States and choose to provide information to us, please note that we transfer the data, including personal information, to United States and process it there.
Your information, including personal information, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
By providing your information, you expressly consent to the place of storage and transfer described above, including transfers outside of the jurisdiction in which the information was provided.
While the data protection laws in the above jurisdictions may be different than the laws of your residence or location, we, our affiliates and our service providers that store or process your personal information on our behalf are each committed to keep it protected and secured, pursuant to this Privacy Policy, laws and regulation that apply to your personal information, and industry standards, regardless of any lesser legal requirements that may apply in their jurisdiction.
6. How Do We Store Your Personal Information?
We retain the Personal Information we collect only for as long as needed in order to provide you with our Services and as required to fulfill the purposes for which it was collected, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce agreements, and comply with applicable laws and regulations.
We determine the appropriate retention period for personal information based on the amount, nature, and sensitivity of the personal information being processed, the potential risk of harm from unauthorized use or disclosure of the personal information, whether we can achieve the purposes of the processing through other means, and on the basis of applicable legal requirements (such as applicable statutes of limitation).
Upon expiration of the applicable retention periods, we then either delete from our systems or anonymize it without further notice to you (except to the extent such data in whole or in part to comply with any applicable rule or regulation and/or response or defend against legal proceedings versus us or our affiliates).
When you access or use the Services, we may use industry-wide technologies which store certain information on the Remmie Device and/or your smartphone or other mobile device and which will allow us to enable automatic activation of certain features, and make your Services experience much more convenient and effortless.
7. How Do We Protect Your Personal Information Security?
We take appropriate precautions including organizational, technical, and physical measures to help safeguard against accidental or unlawful destruction, loss, alteration, and unauthorized disclosure of, or access to, the personal information we process or use.
Despite these efforts, no security measures are perfect, and no method of data transmission or storage is guaranteed to prevent unauthorized disclosure or misuse. As a result, we cannot ensure or warrant the security of any personal information you provide to us. We urge you to use the strongest password combination available on your mobile device and employ reasonable physical security means to protect unauthorized access. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.
8. What Are Your Rights Regarding Your Personal Information?
Depending on the applicable privacy and data protection laws that apply to your situation, you may be able to exercise the following rights regarding your personal information processing by us:
a. Right to Access
You have the right to require: the confirmation on whether we process your personal information or not; a copy of such personal information; and information on the use of your personal information in a clear, transparent, and understandable way (as provided in this Privacy Policy).
b. Right to Rectification
You have the right to require the rectification of your personal information that may be obsolete, inaccurate or incomplete.
c. Right to Erasure
You have the right to require the erasure of your personal information, when one of the following conditions applies:
your personal information is no longer necessary for the purposes for which we collected it or otherwise processed;
you retract your consent on which the processing of your personal information is based, and we have no other legal basis for the processing;
you object to the personal information processing and we have no compelling legitimate grounds for processing your personal information;
the use that is made of your personal information does not comply with the applicable legal or regulatory provisions.
d. Right to Restriction of Processing
You have the right to require the restriction of the personal information processing during a limited period of time, in particular in order to carry out some verifications, if one of the following conditions applies:
you contest the accuracy of your personal information, and wish to restrict the processing of your personal information during the period required of us to verify the accuracy of your personal information;
the personal information processing is unlawful and you oppose the erasure of your personal information and request the restriction of their use instead;
we no longer need your personal information for the purposes of the processing, but you require them for the establishment, exercise, or defense of legal claims;
you have objected to the processing of your personal information, and wish to restrict their processing pending the verification of whether our compelling legitimate grounds for processing override your grounds for objecting to it.
e. Right to Data Portability
You have the right to require us to provide you with your personal information that you have provided to us, in a structured, commonly used and machine-readable format. You also have the right to require us to transmit this data to another data controller. This right is not exercised in all circumstances, it applies only if it fulfils all the following conditions:
your request is only related to your personal information (excluding anonymous or third-party data);
your request does not adversely affect the rights or freedoms of others, in particular those of us (including trade secrets);
the processing is carried out by automated means (paper files are therefore not included);
the processing is based on consent or the performance of a contract.
f. Right to Object
You have the right to object to our processing of your personal information at any time if:
the processing is based on our legitimate interest; or
your personal information are processed for direct marketing purposes.
We will no longer process your personal information unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, such as the respect of a legal obligation (e.g. legal obligation involving the retention of personal information), or for the establishment, exercise or defense of legal claims.
g. Right to Withdraw your Consent
You have the right to withdraw your consent when it has been obtained, without this withdrawal affecting the lawfulness of the personal information processing operations previously carried out.
In addition, you can control your personal information by exercising the opt-out option of the following:
Email communications: To stop receiving future emails, simply click on the unsubscribe link located at the bottom of any email. Please note that you will still receive other transaction-related emails that you have specifically requested. Certain types of important communications, such as updates to our terms or Privacy Policy, cannot be opted out of.
Push notifications: If you wish to opt out of receiving push notifications through our mobile applications, you can do so by adjusting the settings on your mobile device.
Do Not Track (DNT): DNT is a privacy preference available in some web browsers, and we respect it on our website. However, please be aware that the DNT preference does not apply to our mobile applications.
Cookies and similar technologies: You have the ability to control the placement of cookies and similar technologies used on our site according to your browser or device settings. You must opt out separately on each browser and device as necessary.
Depending on your country of residence, you may have additional local rights with respect to our processing of personal information. Please note that some of the personal information that we collect, use and share may be exempt from the rights outlined above.
To exercise your rights, please contact us by using the information in Section 14 below. We try to respond to all legitimate requests within one month unless otherwise required by law and will contact you if we need additional information from you in order to honor your request or verify your identity. Occasionally it may take us longer than a month, taking into account the complexity and number of requests we receive.
9. Minors
To open an Account on our Services, you must be over the age of eighteen (18). Without relieving you of your responsibility to comply with the Terms of Service and the terms hereof, we reserve the right (without obligation) to request proof of age at any stage so that we can verify that minors under the age of eighteen (18) are not using our Services.
If you have added and listed a Patient under the age of 18, you hereby declare to Remmie that you are the parent or legal guardian of such Patient or that you are a Clinician authorized to provide care for such Patient:
For Parents or Guardians. If you are a parent or guardian, you may use the Services, to provide personal information on behalf of your child or dependent who is under the age of eighteen (18) by adding and listing them under your Account. In such case, you (in your capacity as parent or guardian) assume full responsibility for ensuring that the information that you provide to Remmie about your child or dependent is kept secure and accurate.
For Clinicians: If a Patient is under the age of eighteen (18), you hereby declare that you have all of the required consents, approvals, and rights to provide health services to such Patient, including the receipt, access, processing, transmitting, displaying and providing personal information on the minor’s behalf.
The Services are not directed to children under 18 (or the applicable age required by local law). We do not knowingly collect personal information from minors without the permission of a parent or guardian. If you learn that your child has provided us with personal information without your consent, please contact us as set forth below immediately. If we find that any information was collected in violation of the law or not in accordance with the terms herein, we reserve the right to prohibit and block such user from accessing our Services and will make all efforts to promptly delete any personal information with regard to such user.
10. Promotional Information Opt Out
If you provide us with your contact details through the Services, for the purpose of receiving from Remmie different offers with respect to the our Services, you hereby agree that we may use such contact details, in order to contact you, inform you regarding our products and services which may interest you, and send you other marketing material, including news and updates by transmission to the e-mail address or phone number you have provided.
You may opt out of receiving promotional messages from us at any time by following the instructions in those messages sent to you or by contacting us at any time using the Contact Us information at the end of this Privacy Policy. If you opt out, we may still send you non-promotional communications, such as those about your account, about Services you have requested, or our ongoing business relations.
11. Third Party Websites
While using the Services you may encounter links to third party websites and/or services. Please be advised that such third-party websites and/or services are independent from Remmie, and may use cookies and other web-tracking technologies to collect information about you. We assume no responsibility or liability whatsoever with regard to privacy matters or any other legal matter with respect to such third-party websites and/or services. We encourage you to carefully read the privacy policies and the terms of use of such third-party websites and/or services, as their terms, not ours, will apply to any of your interactions with such third parties. Remmie has no control over the use of any information you provide by these third-party services.
12. Changes to the Privacy Policy
This Privacy Policy may be updated periodically to reflect changes in our personal information practices. So please re-visit this page frequently. We will notify you of any significant changes to our Privacy Policy and indicate at the top of the notice when it was most recently updated. If we update this Privacy Policy, in certain circumstances, we may seek your consent. Your continued use of the Services after the Last Updated date will constitute acceptance of, and agreement to be bound by, those changes.
13. Compliance with HIPAA Privacy Regulations
Our privacy practices are intended to comply with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). Although we are not necessarily a “Covered Entity” as defined under the HIPAA Privacy Rule (45 C.F.R. Section 160.103), we will use commercially reasonable efforts to comply with HIPAA rules and to safeguard sensitive user data. If any Covered Entity (such as Clinicians) receives, maintains, transmits, or otherwise processes any information that includes or constitutes “Protected Health Information” (“PHI”) through the Services, such Covered Entity shall enter into a Business Associate Agreement with Remmie prior to receiving, maintaining, transmitting, or otherwise processing this information. We encourage you to review the Clinician’s notice of privacy practices, which describes how the Clinician may use and disclose your PHI to us and others.
